Terms of Use
If you are in immediate danger, are having a medical or mental health emergency, or may harm yourself or someone else, call your local emergency number or go to the nearest emergency room. In the US, call or text 988 or call 911. Skillcard is not an emergency service.
1. Agreement and scope
These Terms of Use (the "Terms") are a binding agreement between you and Mental Fuel Inc., a Delaware corporation ("Mental Fuel", "we", "us" or "our"). Skillcard is a product of Mental Fuel. These Terms govern your use of the Skillcard mobile application, its related webpages, content and features (the "Service" or "the App").
By downloading or using Skillcard, creating an account or buying a subscription, you agree to these Terms and our Privacy Policy, including its Consumer Health Data Privacy Notice. If you do not agree, do not use the App.
2. What Skillcard is
Skillcard is a self-tracking tool for keeping a diary card and practicing skills. Its skills content and exercises are informed by dialectical behavior therapy (DBT). "Informed by" does not mean that Skillcard provides therapy.
Skillcard is not therapy, not a medical device and does not diagnose, prevent, cure or treat any condition or provide medical advice. It is designed to be used alongside professional care, not instead of it. Do not disregard professional advice or delay seeking care because of anything in the App. We do not guarantee improvement or any specific outcome.
3. Emergencies and safety
Skillcard is not a crisis service and is not appropriate for emergencies or situations that need immediate care. The App is not monitored. Nothing you record, share or send through the App, including a high rating or an urge you track, will be reviewed by a person or lead us to contact you or emergency services. The App may show crisis information or safety prompts, but these do not replace emergency services or professional help.
4. Eligibility
You must be at least 18 years old and able to enter into a contract. Skillcard is not directed to anyone under 18. You may not use the Service where doing so would violate sanctions, export controls or other applicable law.
5. Your account
An account is optional. If you create one, you can sign in with Apple or Google. Keep your device and sign-in secure; you are responsible for activity under your account. Tell us promptly if you suspect unauthorized access.
You can delete your account in the App at any time (Settings, Delete account). Deleting your account or the App does not cancel a subscription.
6. Your content and sharing
Your diary belongs to you. You keep all rights in what you enter. You give us permission to store, back up, process and display your content only as needed to provide the features you use, such as backup and share links, and to keep the Service secure.
You decide what to share and with whom. A share link shows the period and fields you select to anyone who has the link until it expires or you stop sharing it. Share links only with people you trust.
7. Subscriptions and payments
Some features require a paid subscription (Skillcard Pro). The price, billing period, any free trial or offer, and what is included are shown before you buy. The App Store or Google Play processes the purchase under its own terms; the price and terms they show control and may include taxes or local currency.
- Payment is charged to your Apple ID or Google Play account at confirmation of purchase, or when a free trial ends.
- Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- You can manage and cancel subscriptions in your app store account settings. Deleting the App or your account does not cancel a subscription.
- A free trial is available once. Any unused part of a free trial ends when you buy a subscription. A discounted first-period offer, if shown, then renews at the regular price.
- If a payment fails, the app store may retry it; access to Skillcard Pro may continue for a limited grace period and is paused if the payment is not recovered.
- Use "Restore" to restore an eligible subscription. If a purchase is pending, refunded, revoked or cannot be validated, access may be delayed, paused or removed.
- Refunds are handled by the app store that billed you, under its policies.
The diary card, your own targets, your full history, backup, all distress tolerance (crisis) skills, 7-day reports and up to two reminders remain free.
Pre-orders. A pre-order bought on our website gives 6 months of Skillcard Pro that does not renew automatically. We turn it on for your Skillcard account; write to us from the email you paid with. After it ends, nothing is charged unless you choose to subscribe.
8. Notifications
If you allow them, the App sends reminders and service messages, such as about your subscription or trial. Notifications are designed not to include diary content. You can turn them off in the App or in your device settings; a missed or delayed notification does not change a subscription or billing date.
9. Analytics and product experiments
The App collects limited events about screens, onboarding, paywall views and purchases to operate, secure and improve the Service. These events never include diary content. We may show different versions of a screen to different people to learn which works better. See the Privacy Policy for details.
10. Privacy
Our Privacy Policy explains how we collect, use, disclose, retain and protect personal information, and Section 13 of it is our Consumer Health Data Privacy Notice. We do not sell personal information and we do not use your diary for advertising.
11. Acceptable use
You may use the Service only for personal, lawful purposes. You may not:
- try to access other users' data or another person's account or share links without permission;
- upload malicious code, probe security, bypass access controls, scrape data or interfere with the Service;
- copy, resell, sublicense or commercially exploit the Service or its content;
- infringe intellectual property, privacy or other rights;
- use the Service to harass or harm anyone or to break the law.
We may investigate suspected misuse and suspend or end access.
12. Intellectual property and feedback
Mental Fuel and its licensors own the Service, its software, design, trademarks and skills content. We grant you a limited, revocable, non-exclusive, non-transferable license to use the App for personal purposes. If you send us a product suggestion, we may use it without restriction or payment; this does not apply to your diary content.
13. Disclaimers
The Service and its content are provided "as is" and "as available". To the maximum extent permitted by law, Mental Fuel disclaims implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and does not warrant that the Service will be error-free, uninterrupted, secure or suitable for your needs. Skills content is general educational information and is not a substitute for professional care. Keep backups if your diary matters to you.
14. Limitation of liability
To the maximum extent permitted by law, Mental Fuel and its affiliates, officers, directors, employees, contractors and licensors will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, or for loss of data, profits, goodwill or opportunity, arising from the Service or from decisions made based on it. To the maximum extent permitted by law, Mental Fuel's total liability arising from the Service will not exceed the greater of USD 1,000 or the amount you paid for Skillcard during the 3 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer.
15. Indemnification
To the extent permitted by law, you will defend, indemnify and hold harmless Mental Fuel and its affiliates, officers, directors, employees, contractors and licensors from third-party claims arising from your unlawful use of the Service, your violation of these Terms or your infringement of another person's rights, except to the extent caused by Mental Fuel's own unlawful conduct.
16. Third-party services
The Service works with third parties such as Apple, Google and our subscription provider. Their terms and privacy notices govern their own services, and we are not responsible for their availability or conduct.
17. Suspension, termination and changes
You can stop using the App and delete your account at any time. We may suspend or end access for a serious breach of these Terms, fraud, a safety or security risk, unlawful conduct, or if we discontinue the Service; where reasonably possible, we will give notice and a way to export your diary. Sections that by their nature should survive, including intellectual property, disclaimers, liability and disputes, survive termination.
We may update, change or discontinue features and update these Terms. The date of the latest version is shown at the top. For material changes we will give reasonable notice in the App. Continued use after the effective date means you accept the updated Terms.
18. App Store terms
If you downloaded the App from the Apple App Store, the Apple Standard Licensed Application End User License Agreement also applies. Apple is not responsible for the App or its content and has no obligation to provide support for it.
19. Governing law and disputes
Delaware law governs these Terms, without regard to conflict-of-law rules, except where the law of the place you live gives you protections that cannot be waived. Before bringing a claim, please contact us so we can try to resolve it informally. Courts in Delaware have jurisdiction unless the law where you live gives you the right to bring a claim in your local courts. Either party may use a small-claims court with jurisdiction.
20. General terms
These Terms, the Privacy Policy and the purchase terms shown by the app store are the whole agreement about the Service. If a provision is unenforceable, it will be changed only as much as necessary and the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger or sale of the Service.
